Jateng – Polda Jateng memberikan tanggapan dan klarifikasi terkait video viral dari Hotman Paris Hutapea mengenai laporan penganiayaan santri di sebuah pesantren di Sragen.
Dalam sebuah keterangan yang diberikan Kabidhumas Polda Jateng, disebutkan bahwa perkara tersebut telah ditangani secara profesional dan sesuai prosedur.
“Agar tidak terjadi mis informasi pada masyarakat kami jelaskan bahwa perkara tersebut sudah ditangani secara profesional dan prosedural oleh Polres Sragen,” ungkap Kabidhumas melalui keterangan tertulisnya pada Minggu (16/4/2023)
Kabidhumas memaparkan sejumlah fakta hukum terkait perkara tersebut. Disebutkan bahwa pada saat kejadian penganiayaan tersebut, pelaku masih berusia 16 tahun 8 bulan.
“Berkaitan dengan pasal 32 ayat ayat 1 UU no 11 tahun 2012 tentang sistem peradilan Pidana Anak, penahanan anak sebagai upaya terakhir apabila memperoleh jaminan dari orang tua nya atau walinya,” lanjutnya.
Disebutkan pula bahwa pelaku bersikap kooperatif selama proses penyidikan dengan selalu absen pada hari Senin dan Kamis di Polres Sragen.
“Tentunya dengan permohonan permintaan tidak ditahan, serta sanggup sewaktu waktu hadir apabila dibutuhkan dalam proses penyidikan menjadi alasan subjektif penyidik terhadap pelaku (anak) untuk tidak dilakukan penahanan,” tambahnya.
Namun demikian, dirinya menegaskan bahwa proses penyidikan perkara tetap berjalan sesuai prosedur sebagaimana mestinya sampai dengan saat pelimpahan Pelaku anak beserta Barang buktinya ke kejaksaan (Tahap 2).
“Dan saat ini, perkara dimaksud sudah pada tahap persidangan,” ujar Kabidhumas.
Pihaknya juga terus menunggu perkembangan mengenai fakta-fakta persidangan dan berkomitmen untuk menindak lanjuti setiap perkembangan.
“Termasuk jika ada pihak lain yang terbukti turut serta ikut melakukan maka akan dimintai pertanggung jawaban secara pidana dan diproses sebagaimana mestinya,” pungkasnya.(Redaksiswanara)
