Jakarta – Penjabat (Pj) Gubernur DKI Jakarta Heru Budi Hartono menegaskan kepada seluruh Aparatur Sipil Negara (ASN) di lingkungan Pemerintah Provinsi (Pemprov) DKI Jakarta agar tidak berfoto ataupun menyukai (like) unggahan kegiatan calon presiden (capres) dan cawapres di media sosial.
“ASN harus netral. Bahkan foto dengan pasangan capres dan cawapres tertentu saja tidak boleh. Foto tersebut disebar di media sosial juga tidak boleh. Itu yang mau saya ingatkan kepada seluruh ASN di lingkungan Pemprov DKI Jakarta,” ujarnya.
Pj Gubenur Heru menyebut, pihaknya juga akan mengumpulkan seluruh pejabat eselon II untuk mengingatkan terkait netralitas yang harus dimiliki ASN DKI Jakarta dalam mencegah konflik pada saat Pemilu 2024 dan menciptakan suasana Kota Jakarta tetap kondusif, aman dan tenteram.
Pj Gubenur Heru meyakini ASN DKI Jakarta mampu menjaga netralitas selama pelaksanaan tahapan Pemilu 2024. Sikap menjunjung tinggi netralitas juga dapat berdampak pada pelayanan masyarakat yang baik sesuai dengan tugas, pokok, dan fungsi (tupoksi) masing-masing.
Ada tiga undang-undang yang menegaskan ASN harus bersikap netral.
Pertama, UU Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara dalam pasal 2 yang menyatakan setiap pegawai ASN harus patuh pada asas netralitas dengan tidak berpihak dari segala bentuk pengaruh manapun dan tidak memihak kepada kepentingan tertentu.
Dalam UU Nomor 7 Tahun 2017 tentang Pemilihan Umum juga terdapat pasal soal netralitas ASN. Lalu,
Dalam UU Undang- Undang Nomor 10 Tahun 2016 tentang Pemilihan Kepala Daerah terdapat dua pasal yang mengatur tentang netralitas ASN yaitu pada Pasal 70 dan Pasal 71.
Pasal 70 ayat (1) berbunyi dalam kampanye, pasangan calon dilarang melibatkan aparatur sipil negara, anggota Kepolisian Negara Republik Indonesia, dan anggota Tentara Nasional Indonesia.
Pelanggaran atas ketentuan tersebut dikenakan sanksi pidana paling lama enam bulan penjara dan denda paling banyak enam juta sebagaimana disebutkan dalam Pasal 189.
Pasal 71 ayat (1) berbunyi pejabat negara, pejabat aparatur sipil negara, dan kepala desa atau sebutan lain/lurah dilarang membuat keputusan dan/atau tindakan yang menguntungkan atau merugikan salah satu calon selama masa kampanye.
Pelanggaran atas ketentuan tersebut dikenakan sanksi pidana paling lama enam bulan penjara dan denda paling banyak enam juta sebagaimana disebutkan dalam Pasal 188.(Redaksiswanara)
