Jakarta. – Pakar Hukum Pidana Azmi Syahputra mengatakan bahwa putusan majelis hakim dalam menghukum Ferdy Sambo patut diapresiasi.
Pada Senin (13/2) ini, Majelis Hakim Pengadilan Negeri Jakarta Selatan memvonis Ferdy Sambo dengan hukuman mati. Majelis hakim yang diketuai Wahyu Iman Santoso menilai Ferdy Sambo terbukti sebagai dalang pembunuhan berencana Brigadir Nofriansah Yosua Hutabarat, yang merupakan mantan ajudannya.
Menurut Azmi yang Dosen Fakultas Hukum Universitas Trisakti ini, putusan hakim itu menunjukkan kualitas hakim dalam mempertimbangkan fakta dan bukti.
Adapun putusan hakim tersebut menjadi bukti bahwa hakim, selaku tiang utama penegakkan hukum, mampu menjaga kewibawaan peradilan.
“Bahkan hakim juga telah berani menjatuhkan hukum yang lebih tinggi dari tuntutan jaksa,” imbuhnya,Senin (13/2) malam.
Sebelumnya, jaksa menuntut penjara seumur hidup untuk Ferdy Sambo.
Azmi juga berpendapat bahwa hakim telah berhasil dan mampu mewujudkan harapan keadilan masyarakat, terutama keluarga korban. Ia berharap ke depannya putusan hakim itu akan menjadi tonggak penegakkan “hukum yang berkeadilan”.
Azmi menilai bahwa putusan hakim itu menjadi peringatan bagi pejabat negara agar tak menyalahgunakan jabatan serta sarana yang melekat pada jabatannya. “Jika pejabat melakukan kejahatan dengan menyalahgunakan jabatan, maka akan mendapatkan sanksi pidana yang keras dan tegas,” pungkasnya.
Dalam kasus Ferdy Sambo yang berpangkat jenderal bintang dua menurut Azmi, “Seharusnya ia adalah polisinya polisi dan menjadi teladan dalam penegakan hukum, termasuk bagi masyarakat. Namun, ia malah melakukan hal yang bertentangan dengan jabatannya.”
“Putusan hakim ini akan menjadi peringatan keras bagi pejabat agar sadar diri dan tahu diri akan kewajiban serta tanggung jawab dalam menjalankan jabatannya,” tutupnya.
Azmi juga memandang putusan hakim ini juga tak lepas dari terbukanya kasus ini di depan publik. Sehingga kerja Jaksa Penuntut Umum harus menyajikan dakwaan dan tuntutan yang tanpa celah. Karena semua akan diadu dalam sidang terbuka. Dakwaan jaksa tentunya hasil penyidikan polisi yang sempat diragukan publik.
