Dari hasil investigasi awak media menemukan maraknya peredaran rokok ilegal merek Hmind dan luffman yang merugikan negara dan telah mengengkangi ketentuan regulasi pajak negara yang di atur pada Pasal 31 ayat (1) UU Nomor 28 Tahun 2009 tentang Pajak Daerah dan Retribusi Daerah.

Hery marhat menjelaskan kalau marak nya rokok ilegal ahir ahir ini adalah gambaran kegagalan pemerintah dalam menyelenggarakan negara ini, Pemerintah dan aparat penegak hukum jangan hanya bisa mengambil pajak dan cukai rokok saja, sementara tidak melakukan penindakan terhadap rokok ilegal dan tidak melakukan idukasi dan sosialisasi kepada masyarakat terkait penggunaan rokok ilegal yang tidak mempunyai jaminan apa apa terhadap kesehatan, dan atau sebab akibat yang di timbulkan dari produsen rokok ilegal seperti hmind dan luffman secara nigatif.
Sebenaranya kalau kita bicara tentang rokok Regulasi rokok ibarat dua mata pisau, di satu sisi bermanfaat bagi negara, di sisi lainnya dilarang untuk kesehatan, Meski terlihat sesuatu hal yang bias, namun pajak rokok telah diatur pemanfaatnya dalam undang-undang.
Implementasi manfaat ini bisa dirasakan pada defisit pelayanan kesehatan BPJS (Badan Penyelenggara Jaminan Sosial) bisa ditutupi oleh pajak rokok daerah sesuai dengan peraturan PMK No.113/PMK.02/2018, jadi pajak dan cukai hanya bisa di lakukan kepada peroduksi rokok resmi atau legal maka seharusnya pemerintah tidak ada satu kebijakan toleransi hukum terhadap pelaku yang melanggar

Masih hery marhat mengatakan, keberadaan rokok hmind dan luffman yang sudah menguasai pasar di berbagai daerah dan telah di minati oleh masyarakat indonesia, sementara status rokok ini masih ilegal tentu bukan saja merugikan negara juga sangat berpotensi membuat produsen rokok resmi mengalami kebangkrutan akibat persaingan yang tidak sehat.
Selain itu kerna rokok Hmind dan luffman ilegal ini relatif murah, maka sangat berpotensj mendorong perokok pemula menjadi perokok aktif.
Menurut hery marhat, jika aparat penegak hukum, pemerintah kota batam dan KPU Bea dan cukai kota batam jika ingin serius membasmi rokok Hmind dan Luffman sangat gampang,kerna modus operendi yang merka lakukan dengan menggunakan setiap pelabuhan tikus yang ada di batam.kemudian memanfaatkan preman preman kampungan yang tak mempunyai pendidikan alias buta hurup untuk memback up para teman teman yang kritis untuk di berikan uang tutup mulut ( UTM) ujar hery marhat.
