Semarang – Sejak digulirkannya program penegakan hukum progresif melalui metode restorative justice, Polri telah menangani 18.359 perkara dengan restorative justice sepanjang 2022.
Kepala Biro Pembinaan dan Operasional Bareskrim Polri, Brigjen Polisi R. Yoseph Wihastono Yoga Pranoto mendorong implementasi restorative justice untuk dapat meredam kontroversi di masyarakat terkait permasalahan hukum.
Yoseph mencontohkan, kasus pencurian sandal bila diproses hukum maka hukuman mencapai 5 tahun penjara, melebihi hukuman kasus korupsi Angelina Sondakh. Lalu seperti kasus pencurian tembakau, dan seterusnya. Hal ini tentunya memicu kontroversi masyarakat terkait keadilan hukum.
“Segala (perkara) ini akan terus berlanjut menjadi kontroversi bila tidak ada terobosan hukum (restorative justice),” ungkap Yoseph dalam keterangannya, Rabu (15/2/2023). Ia menyampaikan itu saat Seminar Sekolah Akpol 2023 di Gedung Serbaguna Akpol.
Untuk itu, Yoseph mengatakan di samping memberikan kepastian hukum, Polri juga berkomitmen mengedepqnkan hukum progresif yang berazas mengedepankan keadilan dan kebermanfaatan bagi semua pihak yang terlibat.
Sementara, Gubernur Akademi Kepolisian, Irjen Pol Suroto mengatakan, sejak menjadi taruna Akademi Kepolisian, hukum progresif ini sudah dicanangkan kepada calon Perwira Polri.
“Dari kegiatan kita hari ini, memberikan bekal kepada mereka untuk belajar mengkaji isu yang menonjol dan menarik ada di masyarakat,” ujar Suroto.
Menurut Suroto, bentuk dari hukum progresif yakni restorative justice yang sudah diterapkan oleh aparat penegak hukum. Pihak kepolisian diminta untuk menyelesaikan perkara di luar pengadilan secara humanis.
“Dari restorative justice ini diharapkan polisi bisa menegakkan keadilan. Tapi jangan sampai hal ini dimanfaatkan untuk hal lain. Maka perlu kontrol untuk menegakkan rasa keadilan. Jangan untuk kepentingan antar penyidik,” jelasnya.
Menurut Suroto, apabila hukum progresif bisa diterapkan dengan baik, maka tingkat kepercayaan masyarakat terhadap aparat semakin membaik.
“Intinya ini perlu integritas semua aparat penegak hukum. Jadi supaya hukum progresif bisa diterapkan dengan baik dan memberikan manfaat ke masyarakat,” ucapnya.
Kepala Lembaga Pendidikan dan Pelatihan Polri, Komjen Pol Rycko Amelza menyampaikan kepada seluruh taruna Akpol yang menjadi peserta untuk menyiapkan strategi hukum. Terlebih untuk menjawab semua keluhan masyarakat selama ini.
“Hilangnya integritas berujung pada ketidakpercayaan masyarakat. Hukum progresif adalah hukum yang memberikan kebahagiaan dan keadilan manusia,” pungkasnya.(Redaksiswanara)
