Jakarta.- Polda Metro Jaya melakukan asistensi kasus penganiayaan yang dilakukan MDS (20) seorang anak pejabat Direktorat Jenderal Pajak (DJP) Kementerian Keuangan terhadap D (17). Kasus tersebut tengah ditangani oleh Polres Metro Jakarta Selatan.
“Sejak awal menjadi perhatian, Pak Kapolda langsung melakukan asistensi gelar perkara terhadap kasus yang ditangani Polres Metro Jakarta Selatan,” ujar Kabid Humas Polda Metro Jaya Kombes Pol. Trunoyudo Wisnu Andiko saat melakukan konferensi pers di Jakarta, Senin (27/2/2023).
Kombes Pol. Trunoyudo menambahkan ada dua peristiwa penyidikan dalam kasus tersebut yaitu proses formil dan materil.
“Perlu diketahui kejadian itu ada penanganan penyidikan dalam dua peristiwa penyidikan ini ada tahapan yang harus dilalui dalam proses penyidikan proses formil dan materil,” ujar Kombes Pol. Trunoyudo.
Kombes Pol. Trunoyudo menjelaskan peristiwa pertama adanya perbuatan pidana yang tentunya telah ditetapkan tersangka terhadap keduanya yaitu MDS dan S maka dalam peristiwa ini penyidik patuh dan taat pada sistem pedoman umum pada KUHP dan KUHAP.
Kemudian pada peristiwa kedua tentunya penyidik patuh dan taat pada sistem peradilan anak dan undang-undang perlindungan anak, tentu ini berlaku kepada anak sebagai anak yang berhadapan dengan hukum.
“Sehingga terhadap peristiwa keduanya, ada proses formil yang berbeda. Terhadap anak, ada hak-hak anak yang harus penyidik lewati dan membutuhkan waktu serta dimohon untuk menunggu hasilnya, ” ucap Kombes Pol. Trunoyudo.
Sebelumnya Polres Metro Jakarta Selatan menetapkan tersangka pria berinisial MDS karena diduga telah menganiaya pria berinisial D di kawasan Ulujami, Pesanggrahan pada Rabu (22/2).
Sedangkan tersangka S ditetapkan sebagai tersangka oleh Penyidik Polres Metro Jakarta Selatan dalam kasus penganiayaan di Pesanggrahan pada Kamis (23/2).
Tersangka S yang melakukan perekaman dan provokasi terhadap MDS disangkakan pasal 76c Juncto Pasal 80 UU Nomor 35 Tahun 2014 tentang Perubahan atas UU RI Nomor 23 Tahun 2002 tentang Perlindungan Anak dengan ancaman pidana maksimal lima tahun subsider.
Sedangkan tersangka MDS yang melakukan penganiayaan disangkakan Pasal 351 ayat 2 tentang Penganiayaan Berat dengan ancaman pidana maksimal lima tahun.
