SURABAYA – Subdit I Indagsi Direktorat Reserse Kriminal Khusus (Ditreskrimsus) Polda Jatim berhasil mengamankan dua orang laki-laki berinisial SS (31 tahun) dan RGS (32 tahun), keduanya merupakan pemalsu kosmetik dari merk IMPLORA, atau merk milik PT. Implora Sukses Abadi.
Berdasarkan laporan dari masyarakat yang telah membeli kosmetik dengan merek IMPLORA dari akun Shoope atas nama POMELLO OFFICIAL, mencurigai bahwa kosmetik yang dijualnya adalah palsu.
AKBP Oki Ahardian menjelaskan, dari laporan tersebut penyidik melakukan penyelidikan dan mendapatkan informasi bahwa kosmetik merek ternama itu telah diproduksi oleh para pelaku di Jl. Cluster Opal Selatan II No. 8 Pakulonan Barat, Kelapa Dua, Gading Serpong, Tangerang, Banten dan diperdagangkan secara online di aplikasi Shoppe dengan nama akun POMELLO OFFICIAL.
Gerak cepat Ditreskrimsus Polda Jatim pada tanggal 24 November 2022 bersama Penyidik Unit III Subdit I Indagsi melakukan penggeledahan dan penyitaan barang bukti di rumah yang telah disewa oleh pelaku SS dan RGS di Jl. Cluster Opal Selatan II No. 8 Pakulonan Barat, Kelapa Dua, Gading Serpong, Tangerang, Banten.
“Kedua pelaku sejak bulan Februari 2022 sampai dengan bulan November 2022 telah memproduksi kosmetik merek IMPLORA yang diduga hasil tindak pidana merek tanpa seizin pemegang merek, yaitu PT. Implora Sukses Abadi dan dengan menggunakan izin edar milik PT. Implora Sukses Abadi,” tambahnya.
Kosmetik palsu itu oleh pelaku dibandrol dengan harga 20 ribu rupiah per piece (pcs), sedangkan kosmetik yang asli harganya 35 ribu rupiah per pcs.
Akibat perbuatannya para pelaku melanggar Tindak Pidana merek dan Tindak Pidana Kesehatan, Pasal yang disangkakan. Pasal 100 ayat (2) Undang-Undang Nomor 20 Tahun 2016 tentang merek dan indikasi geografis, Pasal 102 Undang-Undang Nomor 20 Tahun 2016 tentang merek dan indikasi geografis, dan Pasal 197 Jo Pasal 106 ayat (1) Undang-Undang Nomor 36 Tahun 2009 kesehatan.(Redaksiswanara)
