Jakarta – Keputusan kepolisian untuk menjerat pimpinan Khilafatul Muslimin, Abdul Qadir Hasan Baraja dengan pasal terkait penyebaran berita bohong dan ormas dinilai tepat oleh Ahli hukum Universitas Pancasila, Agus Surono.
Menurut Agus, pimpinan Khilafatul Muslimin itu telah melakukan penyebaran berita bohong kepada masyarakat pada saat melakukan ceramah du Harlah PPUI, Bekasi. Kemudian ceramah itu diunggah dan disebarluaskan di media sosial.
Ceramah itu berjudul, “Hanya Orang Biadab Yang Mau Tunduk dan Patuh kepada Aturan Selain Aturan Allah”.
“Abdul Qadir Hasan Baraja yang mengaku sebagai khalifah/amirul mu’minin saat ceramah di acara harlah PPUI Bekasi dan diunggah di media sosial dapat dikualifikasikan dalam pasal 14 UU Nomor 1/1946, tentang Peraturan Hukum Pidana,” kata Agus dalam keterangan tertulisnya, Rabu (8/6/2022).
Kelompok Khilafatul Muslimin juga menjadi sorotan publik karena menggelar konvoi di daerah Cawang, Jakarta Timur yang terdiri atas anak-anak dan dewasa. Dalam konvoi itu, beberapa peserta mengibarkan bendera dan membawa poster bertuliskan “Sambut kebangkitan Khilafah Islamiyyah”.
Menurut Agus, tindakan itu dapat diproses pidana dengan pasal penyebaran berita bohong dan pasal tentang ormas.
Agus menjelaskan, orang orang melakukan konvoi rombongan membagikan selebaran khilafah dikategorikan dalam pasal 15 UU Nomor 1/1946 tentang Peraturan Hukum Pidana. Sebab, para peserta konvoi telah menyiarkan kabar yang tidak pasti atau kabar yang berlebihan atau yang tidak lengkap.
“Kabar demikian akan atau mudah dapat menerbitkan keonaran dikalangan rakyat,” demikian kata guru besar Ilmu Hukum tersebut.
Agus juga mengapresiasi tindakan tegas pihak Polda Metro Jaya dan Polri yang langsung ikut serta turun langsung dalam kasus yang dapat menyeruak besar tersebut.
Abdul Qadir Baraja ditangkap di Lampung kemarin (selasa, 07/06) pukul 06.30 WIB. Dia tahan di Rutan Polda Metro Jaya. Polisi menyatakan masih mendalami kasus tersebut, sehingga memungkinkan adanya pelaku lain.
Abdul Qadir Baraja dijerat dengan Pasal 59 ayat 4 juncto Pasal 82 ayat 2 UU RI Nomor 16 Tahun 2017 tentang Ormas dan Pasal 14 ayat 1 dan ayat 2 dan/atau Pasal 15 UU Nomor 1 Tahun 1946 tentang Peraturan Hukum Pidana dengan ancaman maksimal 20 tahun penjara.(red)
