TOBASA, Terhadap Kasus tuduhan pencabulan dan ditangkap dan ditahannya B.E.M. (34) oleh Polres Toba Provinsi Sumatera Utara tampaknya akan berbuntut panjang
Pasalnya, Pihak keluarga menyampaikan melalui Kuasa Hukumnya tidak terima atas tuduhan pencabulan anak dibawah umur dari pihak pelapor yang terjadi di kabupaten Tobasa diduga telah menyalahi Prosedur alias cacat Hukum
Atas penahanan tersangka yang di lakukan Polres Toba diduga banyak kejanggalan hal itu, mengacu Pasal 17 KUHAP, penangkapan dilakukan terhadap seorang yang diduga keras melakukan tindak pidana berdasarkan bukti permulaan yang cukup.
Melalui keterangan tertulisnya dari Badan Perbantuan Hukum Pemuda Batak Bersatu (PBB) DPD Sumatera Utara Paul J J Tambunan, SE.,SH.,MH, Mathin Van Hof Manurung,SH, dan Marudut Hasiholan Gultom.,S.H menyampaikan beberapa hal terkait ditangkap dan ditahanya Klien mereka atas nama B.E.M oleh Polres Toba atas dugaan tindak pidana perbuatan cabul terhadap anak dibawah umur. Melalui Badan Bantuan Hukum Pemuda Batak Bersatu (PBB) DPD Sumatera Utara memohon agar Pra Rekonstruksi dan Rekonstruksi terhadap laporan Polisi Nomor: LP/B/344/VII/2022/SPKT/Polres Toba/Polda Sumut Tanggal 21 Juli 2022 segera dilakukan.
Menurut Badan Perbantuan Hukum PBB DPD Sumut sebagai penasehat hukum tersangka, kejadian berawal ketika B.E.M merupakan Putra Daerah Sosor Dolok, Desa Parbagasan Janji Matogu Kec. Uluan Kab. Toba yang saat ini merantau ke Purwakarta Jawa Barat, pulang ke kampung halaman untuk mengantarkan anaknya yang akan memasuki kegiatan belajar di bangku kelas 1 (satu) SD disalah satu sekolah di Kab. Toba, hal ini dikarenakan keadaan ekonomi B.E.M. dan istrinya yang tergolong lemah sehingga mereka sepakat mengantarkan anaknya untuk bersekolah di kampung atas bantuan dan biaya dari beberapa saudara mereka.
Tepat Pada tanggal 18 Juli 2022 anak tersangka kepingin mandi/berenang di sungai Sosor dolok desa Parbagasan dekat rumah kakeknya. Setiba sampai di Sungai tersebut, tersangka dan Putranya melihat ada beberapa orang anak kecil sedang mandi dan berenang di sungai, Hal ini membuat putra tersangka kepingin ikut mandi dan berenang bersama dengan anak-anak lainya dimana yang salah satunya yang saat ini menjadi korban anak dari orang tua pelapor.
Dimana saat itu anak-anak tersebut sudah hampir selesai mandi dan berenang dan seperti biasa layaknya anak kecil dalam keadaan telanjang dimana salah satu anak tersebut telah dikenal oleh anak tersangka merupakan teman sekelas anak tersangka.
Bahwa sewaktu anak tersangka bersama seorang anak perempuan yang saat ini diduga menjadi korban pencabulan bermain main dengan menyiram nyiramkan air kepada teman perempuanya sehingga anak perempuan tersebut hampir tenggelam.
Melihat anak perempuan tersebut hampir tenggelam, tersangka yang sedang bermain HP sambil menjaga anak-anak tersebut bermain, spontan membantu dan menangkap serta menggendong anak perempuan tersebut lalu membawanya ke darat dengan maksud menyelamatkan si anak perempuan agar tidak tenggelam disungai lalu anak perempuan tersebut selanjutnya memakai pakaiannya dan pergi ke sumur dimana sumur tersebut merupakan tempat biasa warga dan anak-anak mandi serta menyuci peralatan dapur.
Saat tersangka sudah kembali ke purwakerto jawa barat sekitar awal september 2022 tersangka menerima Surat Perintah Dimulai Penyidikan Terhadap Terlapor B.E.M dari kepolisian Polres Toba dimana tersangka dilaporkan orang tua korban pada tanggal 21 Juli 2022 dengan tuduhan telah melakukan dugaan tindak pidana Pencabulan kepada anak pelapor.
Selanjutnya atas dasar Itikad baik Klien Kami B.E.M berangkat dari Purwakarta dan tiba di Porsea tanggal 8 september 2022 untk mengklarifikasi tuduhan dan membersihkan nama baik keluarga dikampung halamannya agar tidak berlarut-larut mengingat keluarga Klien Kami memiliki permasalahan pribadi kepada pihak Pelapor dikarenakan persoalan Pemilihan Kepala desa dan permasalahan tanah dimana orangtua Klien Kami tidak berpihak kepada pihak orang tua pelapor.
Keesokan harinya pada tanggal 09 September 2022 pihak Polres Toba kurang lebih 6 orang langsung mendatangi kediaman orangtua tersangka tanpa membawa surat perintah penangkapan dari atasan mereka dan mereka langsung membawa paksa tersangka ke polres toba dan langsung dijadikan tersangka.
Penasehat Hukum Tersangka juga berharap agar Penyidikan ini dilakukan secara Presisi seperti slogan Bapak Kapolri Listyo Sigit Prabowo, serta Instansi yang berperan terhadap kasus Tindak Pidana Pencabulan terhadap anak dibawah umur khususnya perempuan harus berperan aktif.
sehingga Penyidik Polres Toba perlu menggandeng instansi seperti Komnas PA, LPAI, KPAI, LPSK dalam penanganan kasus dugaan tindak pidana pencabulan ini sehingga anak korban segera mendapat fasilitas pendampingan serta perobatan fisik dan psikis dari instansi terkait, dan juga anak dari Tersangka juga mendapat perhatian dari instansi tersebut dikarenakan anak tersangka merupakan teman sekelas dari korban sehingga kedua anak tersebut dapat berinteraksi sosial sebagaimana biasanya sekaligus menlindungi saksi-saksi anak yang diduga kuat berada dilokasi.
Karena kami selaku kuasa hukum menduga saksi yang berada dilokasi hanya saksi anak, sehingga kemungkinan besar tuduhan dari orangtua korban benar, namun jika saksi yang ada saat ini dan sudah di periksa oleh pihak Penyidik adalah orang-orang dewasa sangat disayangkanlah orang dewasa tersebut tidak berusaha mencegah tindak Pidana Pencabulan dari Tersangka B.E.M ini pungkas Paul J J Tambunan dan Marthin Van Hof Manurung.

Ketika ditanya Saksi saksi pada saat itu yang ada dilokasi serta bukti ” Untuk saksi Orang tua korban serta anak anak kecil yang saat itu ada disana” jelasnya. Padahal orang tua korban pada saat itu sedang berada di rumah serta tidak berada dilokasi kejadian saksi yang dimaksud adalah anak dibawah umur 13 tahun
Sementara itu Praktisi Hukum DR.Drs.Riduan Siagian,S.Si.,SH.,MH.,MM Kantor Hukum DANJOS MATHRAS AGIAN di Jakarta Ketika diminta tanggapanya mengenai perihal dengan penangkapan tersangka diduga telah menyalahi prosedur “adapun atas kejadian tersebut kita harus mengedepankan praduga tak bersalah kepada si terlapor andaikan hal itu terjadi, maka pelapor juga dapat dipidanakan berdasarkan Hukum yang berlaku” Ujarnya.(Redaksi Swanara)
