Jakarta – Sengketa tanah antara warga Jimbaran dengan Universitas Udayana (Unud) Bali nampaknya terus bergulir sehingga belum menemukan titik terang dari kasus tersebut, oleh karena itulah maka Dewan Pimpinan Pusat Lembaga Independent Pemuda Pemerhati Indonesia mendorong kasus ini agar segera mendapatkan perhatian serius dari kapolri.
Ketua Umum DPP LIPPI Dedi Siregar dalam pers rilisnya mengatakan bahwa kami meminta kepada penegak hukum pihak kepolisian agar membuka kembali dan menggelar kasus sengketa tanah yang telah merugikan pihak I Nyoman Suastika ( penggugat ), karena menurut informasi yang kami himpun bahwa Putusan Peninjauan Kembali No.PK 451/PK/PDT/2015 tidak sesuai dengan data dan bukti yang ada sehingga diduga kuat adanya pemalsuan data untuk memenangkan pihak Universitas Udayana di upaya hukum PK tersebut.
Dedi Siregar juga menambahkan I Nyoman Suastika adalah warga yang telah dirugikan, atas dasar itu kami tentunya kami mendesak agar persoalan tanah ini dapat di gelar kembali sesuai dengan mekanisme hukum yang ada. Kami juga meminta agar Polri dapat mengusut tuntas permasalahan yang telah meresahkan masyarakat Jimbaran ini dan apabila pihak I Nyoman Suastika menang dalam putusan pengadilan maka agar haknya segera dikembalikan.
Kami yakin dan percaya bahwa Polri dapat mengusut dan kembali menggelar kasus yang telah merugikan warga Jimbaran ini, karna saat ini polri sangat di harapkan untuk dapat menyelesaikan persoalan hukum yang ada di masyarakat secara transparan dan akuntabel.
Seperti diketahui juga bahwa Tim kuasa hukum I Nyoman Suastika (penggugat) I Komang Sutrisna, SH dan Dr. I Gusti Ketut Suastika, SH pada tanggal 23 september 2022 telah membuat surat untuk Kapolri untuk memohon perlindungan hukum agar dapat melanjutkan proses hukum terkait masalah tersebut.
I komang Sutrisna, SH menjelaskan bahwa tanah sengketa tersebut awalnya berstatus tanah adat yang kemudian dibagikan ke masyarakat adat. Dengan status demikian artinya bukan tanah negara. Hal ini dikuatkan dengan bukti persil, pipil, dan peta blok yang ia kantongi.
Tanah yang ada di lokasi Banjar Mekar Sari ini merupakan tanah Hak Milik Adat (HMA) yang ada persilnya dan ada pipilnya di Letter C. Sehingga dia menekankan bahwa ini jelas bukan tanah negara. Hal tersebut ia akui dan dibenarkan oleh Jro Bendesa, bahwa tanah di sekitar Banjar Mekar Sari itu merupakan tanah adat yang telah diserahkan kepada masyarakat.
“Kalau tanah negara, TN namanya atau DN, Darat Negara namanya. Ini nggak ada. Itu jelas tanah milik masyarakat yang dinyatakan tanah milik negara,” jelas Sutrisna.
